How the matter was handled

Royal Decree 316/2026, of 14 April, added to the Immigration Regulation a temporary residence permit on exceptional grounds under the twenty-first additional provision, designed for situations of vulnerability. It is a young provision: when this application was filed it had been in force barely three weeks.

The file concerned a Senegalese national who met the requirements of that route. With so recent a provision there are no earlier files to learn from: every piece of evidence is built from the text of the rule itself, without knowing in advance what the case officer will ask for. We gathered the documents and filed the application in May 2026.

The Directorate-General for Migration Management granted it in September 2026: 127 days between filing and signature. The permit takes effect from the day of the application, not the day it was granted, so those months are not lost along the way.

It runs for one year and allows the holder to live and work anywhere in Spain, as an employee and self-employed alike. Because it lasts more than six months it is fully effective without waiting for the card; even so, the TIE must be applied for at the police station within a month of the grant. It is the second file on this route that we publish.

Every case is unique: it depends on its facts, its evidence and the authority deciding it. The outcome of one matter does not anticipate the outcome of any other, and the timescales given here are the ones that particular file took: they are set by the authorities, not by us.
