How the matter was handled
International protection is not inherited: it is recognised person by person. When the person who holds it is already in Spain and their family is still abroad, one decision is not enough — there must be as many as the family has members. In this matter there were six.
The route is the family extension of article 40 of Law 12/2009 of 30 October, which governs the right of asylum and subsidiary protection. The applications were filed in Spain and handled under the ordinary procedure, in collaboration with the Spanish embassy in the country the applicant had indicated. We prepared the six files and evidenced, one by one, the family link and the requirements article 40.1 sets according to the degree of kinship.
The Inter-ministerial Commission for Asylum and Refuge put forward its proposal, and the United Nations High Commissioner for Refugees (UNHCR) was informed of the file and took part in the meeting. In August 2026 the Minister of the Interior decided all six: to recognise the right to subsidiary protection by family extension for each of the six, all of them Syrian nationals.
These are six decisions, not one: each of the six holds protection of their own, not the reflection of someone else’s. That is why the matter was built as six parallel files — a single one left unproven would have been enough for the family to stay apart.
Every case is unique: it depends on its facts, its evidence and the authority deciding it. The outcome of one matter does not anticipate the outcome of any other, and the timescales given here are the ones that particular file took: they are set by the authorities, not by us.
