The decision
How the matter was handled
Temporary residence on exceptional grounds under the twenty-first additional provision was added to the Immigration Regulation by Royal Decree 316/2026 of 14 April, for situations of vulnerability. When this application was filed it had been in force for little more than a month.
The file concerned a Libyan national who met the requirements of that route. We gathered the documents and filed the application in May 2026.
The Directorate-General for Migration Management granted it in October 2026: 144 days between filing and decision. The permit takes effect from the day of the application, not the day it was granted, so the months of processing fall within its validity.
It runs for one year and allows the holder to live and work anywhere in Spain, as an employee and self-employed alike, in any occupation or sector. It is fully effective without waiting for the card; the TIE is then applied for at the police station within a month of the grant, and the decision itself carries the links — also as QR codes — to the fee and to the EX17 form required. It is the fourth file on this route that we publish.
Every case is unique: it depends on its facts, its evidence and the authority deciding it. The outcome of one matter does not anticipate the outcome of any other, and the timescales given here are the ones that particular file took: they are set by the authorities, not by us.
